Yes, technically, if the buyers never knew about the deal to begin with (despite it being on the open market) and you are adding value in other ways (i.e. you have knowledge about aspects the deal/seller that others don't) then it shouldn't matter that it's on the market, but it often seems to be a big psychological hurdle for buyers nonetheless.
