Be nice, tell him you can't just cut a check, tell him there is no contractual basis for a property that sold, so ask him to put his justification in a letter to you and you'll take it to your partner saying the last thing we want is any backlash.

Would that be legitimate, they still make their interest on $50,000 and I really didn’t put any money down, just if I default they take my home, and I only have to pay up $50k + whatever interest occurs right?

there is no justification necessary... its commission income so you only get paid for success... just ask anyone who has done this for years. and has had sale fails at the very end of the transaction.. they get squat bubkis nothing... so it kind of all averages out.Also think of the legal professionI can hire an attorney in Mississippi for 225 and hour topflight.. top flight attornies in Portland are 425 to 600... and I assume bay area the same... how do they justify it.. the market justify's it.So if people wanted to revolt and not list for the higher commissions its certainly there prerogative...

Hey, I agree Rich, if it's a shot in the dark and you don't know the trends in the area, I won't gp there either, I'd take the 20%, it's just if a neighborhood isn't really bad, just a little common we'll say and it's moving up with activity, I'll take the additional profit.
