The US Tax systems, when compared to the EU, seems to be setup for capitalists. 1031 exchanges, write-offs, etc.

We were offering $300 off first month and just recently increased the incentive to 50% off first month.

I'm not sure if they can realistically pass that liability off to you simply by stating it in their contract.
