I'd say how ever long your state's statute of limitations are for civil cases?

The officers adviced me to seek legal actions stating that they can't do anything to the seller without court orders because it is now a civil case.

Look for civil cases and see if there are any evictions filed under small claims court (that's at least how they are filed here in IN).

California Civil Code section 1671 controls the amount of late fees you can charge. 

My understanding is that it is being litigated at this time
