Hey All,In most cases when you wholesale do you receive your assignment fee via the separate assignment agreement outside of settlement, or is the assignment fee paid from settlement (ie, included on the HUD)?

Well i got a hard-*** litigator involved that I know and it looks like we are headed down the settlement path to salvage this deal.Also, today I found out the mole is a long-time investor in town who has bought a half-dozen houses from me over the years.

Just my opinions here.I'd use the filing of the case and serving the summons to hopefully facilitate a settlement of some kind.  

You can buy personal property from the seller at the time of settlement with a receipt.

The bottom line is that Homesearch (actually Nationstar, the seller) must be able to pass clear, marketable title to you at settlement.

How does the settlement look like in this situation:Advertized rent $10K/moCollected rent $9K in the last month.Should the seller bring uncollected $1K to the closing (or reduce the price)?

Is there significant settlement cracking anywhere?

The title company (or escrow or however settlements are handled in TX) should protect you.

Get a realtor or lawyer to present the contract and at settlement the lawyer will basically take the check minus the lien (send to the gas company) and the rest goes to the owner --- so if you pay 20k she'll end up with $3000Now how are you planning on purchasing?
