If it came in at 340k and you agreed to it before you found out about the discrepancy that is a different story.I would contact your attorney if you had one.

This agreement gives current tenants a chance to disclose the terms of their lease as they know it so that you have a chance to find discrepancies before committing to a purchase.Any discrepancies that arise should be sorted out before closing.
