@Marissa Nadeau doubtful but often when you get a loan based on the fact that you will be living there (ie OO) the contract you sign stipulates that you will live there for a minimum of 1 year.

Its something I would talk to an attorney about, you'd have to get the fine print of the mortgage and make sure there is nothing in there that stipulates that the rest of the mortgage is due upon the seller "signing" over the property.

Burden of proof on them for delivery, and only you can accept it and release funds.Also, I would consult an eviction attorney and see if you can get a stipulated judgment for the eviction and make that a requirement as well.

If you wanted to stipulate that the money you fronted is your equity contribution, you could do that, but you would want the properties to be put into title under your name as well or the name of the business entity so that you could have an equity share.

Account Closed If you stated that you have to deposit $2,500 with the title company, you have to do that within a certain amount of time (whatever is stipulated in your contract and it is required in your area) in order to have a valid contract.
