If the tenant does not move out within 5 calendar days after notice, the tenant is "unlawfully detaining" the premises.

Most poster's here at BP are of the belief that it is universerally unlawful and/or enethical to collect rents on a property that you do not own. 

If they refuse to sign new rental agreement give them your state required notice to vacate (unlawful detainer).

Plus, whenever you file an unlawful detainer (or eviction proceeding in your state), it goes on their eviction report.  

State that you will not be satisfied until your complete deposit is returned and you will seek the maximum permited by law for unlawfully withholding the security deposit..  

This isn't borderline, this is unlawful.

Eviction records are public records and like the current lawsuit on Seattle's ban on criminal records, it's unlawful to restrict access to them.

Net listings are one of their tactics, which are very unlawful in my state.

If you willfully unlawfully detain on the property it won't look good for you either.Renting a unit, without the ability to secure the doors and windows, and without the ability to use a kitchen, is not acceptable.
