There are ways to use loopholes but it has to be done correctly to avoid issues.If you can rent your current home and it cash flows simply do a cash out refinance pull out some cash and use it for a down payment.

If there’s sufficient evidence to conclude that a deal can be made, it may be necessary to go through another round, or even two of offer - counter offer before reaching an agreeable price. 

Or you simply do what wholesalers do and send out mailers offering to buy the note.

If you aren't requiring background checks for someone simply because they aren't a citizen, then you shouldn't require them for people claiming to be citizens.Treat all people equally.
