@Aubrey Ford If the Zoning permit for the basement unit was never pulled you can either just apply for it yourself or hire someone to apply for it for you.

The way to mitigate this risk is by getting a permit to legalize the unit(which may be a bit more difficult) or duplex the unit with digging down the basement to be in compliance with zoning and building codes. 

The cost was $1800 plus the cost of the permits (around $200) for a total of 2k.

Building new sounds great, but it's usually way more expensive per square foot when you factor in land, materials, labor, and permits.
