I do not want to deal with the liability of allowing tenants to use the fireplace, so we have a clause in the contract that stipulates that the fireplace is not operational and is never to be used by tenants.

Given the lease does not stipulate a charge, I don't think a judge would get upset with you for passing on the costs they incurred by not complying with the payment provision.

I saw that caveat while researching 401k arbitrage, but this stipulation about it not being due until taxes are due makes a difference for sure.
