Don't like being on the high end of the rental spectrum in a market either. 

There is a penalty for mortgage fraud, but what you are talking about is hard to prove and not severe on the spectrum of mortgage fraud crimes.

Since it is all timeframe dependent, that is why you are seeing the two ends of the spectrum.

I was even told that there was no guarantee on the tenant - e.g. if the tenant placed needed to be evicted, I would still have to pay for the placement of the new tenant...I suspect this is going to be on the other end of the spectrum of what you will find...
