Second, the judge looks into their finance and see they don't have anything or much, and may give you the win, but a much less amount to give them a chance not to be homeless or whatever it may be (this really depends on the laws of your state and the judge, too many unknowns IMO to gamble).

Some small banks and credit unions prefer to kick any deal where rental income is needed to qualify over to their commercial department so they can swing higher rates, ARMs, and points up-front.You can get a 30YF Agency loan on a residential rental property, assuming no commercial characteristics (storefront etc), the property is in fanciable condition, and you otherwise qualify.

Hi Sandy, if you are looking at reperformers, you should probably be looking at your annualized IRR based on how much you want to earn from the P&I payments, tempered with the risk associated for each asset on the characteristics that both @Scott Carson and @Wayne Snell discuss above.

That's too big a gamble for 50.00....no matter if you're rich or poop....that's just crazy to take a potential tenants money like that up front when it's not a for sure deal.

This just boils down to a question of ethics and integrity as apposed to the few dollars that may be saved today and the gamble that you may get away without and repercussions.
