Nothing you can do about this.As for Lien Waiver- you can have a lien waiver printed on the endorsement part of your checks.

If not, you may be better served with Replacement Cost for the building (Especially if the company will offer Guaranteed Replacement Coverage or 125% or 150% coverage endorsements).

This is how it reads: "All parties to this Note, including maker and any sureties, endorsers, or guarantors hereby waive protest, presentment, notice of dishonor, and notice of acceleration of maturity and agree to continue to remain bound for the payment of principle, interest and all other sums due under this Note and the Deed of Trust notwithstanding any change or changes by way of release, surrender, exchange, modification or substitution of any security for this Note or by way of any extension or extensions of time for the payment of principal and interest; and all such parties waive all and every kind of notice of such exchange or changes and agree that the same may be made without notice or consent of any of them."

In hindsight I could have done more if I had thought it would be out of compliance.Having said that, I relied on disclosures I signed - specifically the "Complaince and Proration Agreement Between Buyer and Seller" stating that "Seller agrees all HOA fees and/or special assessments are paid"Also the ALTA endorsement and Buyers Title Affidavit protecting me from "a failure to disclose present violations of covenants, conditions, restrictions".

If you find a direct endorsed Fannie and Freddie mortgage banker with minimal overlays, the minimum would be 15% for s SFR.
