You can also take a further deduction for rebuilding your now-depleted reserves, but that has to be over a reasonable period of time as well.So you will be paying tax on ordinary income to the extent you pulled money out of the (properly established and safeguarded) reserve account less the amortized expense and a smallish deduction for that year’s contribution to rebuild reserves.

Now, if you’re speaking about some gurus who promote subject to without safeguards to be used by people with no experience or financial ability to withstand a foreclosure action then I agree that it can be an irresponsible act.

Operating legally is definitely not a safeguard as I provided data to the city that was sufficient to demonstrate that it had operated legally at least the last 5 years (but it has operated legally 23 years) to get maximum STR lottery entries.Note this quota occurred after the council initially passed a ban on STRs all together and pulled the regulation when it qualified to go to ballot (council must have expected they would lose the ballot initiative why else pull it without having it go to vote).
