I purchased a non performing note on a vacant property a couple months back and would like to start the rehab during the lengthy foreclosure process - I am under the impression that since I technically do not have possession of the property I am only able to work on the property through a receiver.

During the debacle, while we are attempting to convince the bankruptcy judge to give us possession, a hurricane does damage to the building so extensive that the building is a tear down.

Tenants are still liable for damage, but it just becomes harder to collect as there is no buffer in your possession.
