Your state may be different, but in CA, the surviving spouse would be entitle to 1/3 and the children would, as a group, be entitle to the other 2/3.Since husband is deceased, presuming he did not have a will either not children from a prior marriage, the two disabled children would be entitle to probate Mom's estate.But wait!
