In some states you can be sued for an unlawful eviction. 

This goes back to feudal times and is a concept in our common law.As I said, a DIL must be given by the borrower to the lender not the other way around, which in all of these deed in escrow cases the mortgagee leads the idea which for no clearer way to put it is unlawful and predatory.  

Now you have a party holding title interests evading creditor's interests through foreclosure, actually, an unlawful foreclosure as you can't foreclose against your own interests, much less at the detriment of others who may have an interest.

At that point if they haven't voluntarily vacated, your Attorney will file an "Unlawful Detainer".  

I would begin the unlawful detainer process (Eviction) immediately. 

Now, if for some reason the tenant refused to move out, then at that point you may need to file an eviction (unlawful detainer) to remove them and recover possession of the property.
