Now, sorry to the innocent newbies asking questions, but there are some really bad ideas and information on here, I'd rather see you learn correctly and stay away from civil suits, fines and jail.    

If the case goes to court, it will be a civil case, but not necessarily a probate of the property.  

Some purchase and sales agreements (Lease Purchase) may have specific performance requirements that allows litigation is the buyer doesn't buy, but I don't really recommend adding insult to injury if a buyer doesn't close in a lease purchase by them forfeiting their earnest money AND staring down the barrel of a lawsuit for not buying.

This is a bit of a pet peeve of mine as a Civil Engineer.

Obviously, I have my own firm so I have had the ability to litigate this issue way more than i should.

@Himanshu Jain  you could also pay a civil engineer probably 500 to 1000 bucks and they would write it out for you that is specific to your location and jurisdiction.I do this when I am looking at new areas.

I have been working for a civil engineering firm for the last 2 years and knew I wanted to dive into the REI world and that it could relieve me from a boss or 9 to 5 and provide financial freedom for me and my future family so we could focus on giving back or reinvesting I like to think.
