Your partner shouldn't have the authority to authorize any lease without your signature/explicit consent, especially in a case where you explicitly stated otherwise regarding the tenant in question.

The misapplication of escrow accounts or escrowed funds by a licensened property manager can be grounds for the suspension or revocation of thier license.Which means, it ain't your money to spend until the deposit is forfeited as agreed by contract and as allowed by state law :)

No party of the contract can take the deposit without the other party's consent so if the broker will not return the deposit you may need to go to court to get the court to order the release of your funds.
