In this situation, I would usually request to have the mold and roof leaks repaired/remediated by the seller.

@Shiloh LundahlThey are tenants and not squatters however the remedy is the same......an eviction Obviously, that is not going to happen currently.

I put the offer in on the duplex I bought because they had paperwork and an engineer report on file for what they did to remedy the issue. 

But the thing that bothers me about is that you got mold growing in your property and you are more worried about faults and causes instead of remedying.

I am not naive to think that this doesn't happen, however, if an agent is a member of the National Association of Realtors, this behavior is a clear violation of the code of ethics and there are simpler remedies that sueing.

You need to get rid of a lot of the popcorn to see where the plaster is sagging and needs to be repaired, and it's probably a lot cheaper and easier than hiring out the asbestos remediation of the entire attic to a certified company.You could of course go up to the attic with a shop vac and a bunch of bags, vacuum out all the vermiculite into bags, toss the bags down the hatch, and dump them somewhere.

Our property manager had a handy man install the new fridge.Fast forward to today, I get a call from the Property Manager saying that the new tenant reported water leaking behind the fridge, after a deeper look baseboards are curling up, mold is under the baseboards, and they need to remediate mold and likely replace the floors!

That way if they do not pay on these issues or remedy them then it will be a breach of contract to start a evection process.
