See Treasury Regulation 1.48-12(b).If the taxpayer fails to complete the physical work of the rehabilitation prior to the date that is 30 months after the date the taxpayer filed a tax return on which the credit is claimed, the taxpayer must submit a written statement to the District Director stating such fact and shall be requested to sign an extension to the statute of limitations.

There may be no direct or indirect transactions or benefit between a plan and a disqualified person.If you have management control over the LLC you mention, then the LLC is also considered a disqualified person to your IRA whether you have controlling equity or not.Even if the LLC itself is not disqualified, you are seeing a benefit by having the entity you are involved in receive capital from your retirement plan.

IRS rules prohibited any direct or indirect benefit for such person from his/her retirement account, and as such you are not allowed to furnish any service, goods or facilities to your 401k:https://www.irs.gov/retirement-plans/plan-particip...While in some instances it might be possible to get into an investment together with a disqualified person you must be very careful!

You may need to purchase additional insurance that you do not have now, Directors & Officers coverage, Workers Compensation, Fiduciary coverage, etc that are normal to Insuring a Condo Association,Association Bylaws and Declarations need to be drafted by an Attorney experienced doing it.
