ID theft that results in credit cards being used is often removed by the credit card company when the police report is filed (sometimes even without a police report b/c it is obvious the c.c. use was fraudulent).

I'd guess this deed restriction would only become clear via case law, and I can't imagine that it would ever get that far in the absence of fraudulent intent.

I saw a few of these last ones pushed out in 2009.That won't stop however fraudulent lenders from saying they can still do those loans and separating you from your cash and then making excuses at the last second as to why they can't fund it.
