They currently likely have a prescriptive easement (your state might call it something different) which is an easement by right since they've been in the ground for so long.

I am a physician looking to invest in Houston and Kc area (I lived there for many years and rented my old house for couple of years).

I plan on using a physician loan (0-5% down, no PMI) for the purchase.

Again, I say this from personal experience as a higher-income earner because I work in finance and my wife is a physician. 

We have good faith acquisitive prescription at 10 years and I don't think they would write a policy even after that.
