Sure if you already have problems it could be the easier way out but I don't see that forcing someone to file.In regards to the written letter - I am sure she is covering up that some government agency will be making her deposit and first month rent check.

The more people held responsible for back rent or damages, the more chances you have of collecting your money through garnishments, or collection agencies, etc.Also make sure you get a Co-Signer whenever possible.

Dual agency is illegal in many States, and I don't know of any where an agent can represent both sides if they own the property.
