Anything outside of criminal code  between ADULTS with their mental capacity INTACT is just that: a private transaction where two parties agree to exchange the goods at whatever price they agree to.

I have a cousin who funds RE deals and he has a whole network of money people, so I am putting together a business plan to submit along with my financials and an investment proposal.I am coming from single family residential, and have only ever worked with hard money for short-term loans, and also some smaller amounts of private money.

I work with institutional capital as well as a variety of private money resources to finance such things, but don't again, don't expect to find "low" rates and fees for such.Many investors I come across run into this problem with financing even though they've built up a cash cow... it is hard to understand sometimes, but be aware of the challenges and make sure you have financing options in place for what you are doing before you jump too far in.

That is part of the standard contract that realtors use, but a private party sale could of course be different.  

Examples: Medical Professional Financing (stronger rates and limited down), low down payments of 3.5-10% on jumbo primary, second home or investment properties, 10% down for investment properties of 1-4 units (with no PMI) and portfolio or private loans with attractive ARM or seller carried rates we negotiated.
