I have only done rentals in 2 states and my family in another, but in all 3 states if a month to month rental leaves before giving 30 days notice, they can be charged for the full 30 days or until it is rented - whichever is least.But with a year's lease, it is harder to get non-compliant or aggravating tenants to leave.

You should use existing forms that are compliant with your state and local laws.Most leases I have seen or read have a clause about the landlord's right of entry like @Nathan Gesner said.My local lease says:"Right of Access by Landlord.

But they still want the end game of estate planning and tax free inheritanceSo they're stuck with the 1031 compliant passive choices. 

This is why the separation you mention would not allow you to be compliant with the rules.

I usually encourage people to at least have an attorney draw up their first LLC so they understand the language and can be taught how to keep it compliant.2.

Or just serve up the eviction notice by certified mail for safe record keeping for whatever the reason.After that time frame has ended file a compliant with the counties office for the eviction.Go to court, they decide ,gives a date for eviction , have the sheriff out.Or get an attorney to do the hard work again.
