If not, how will you prove that they caused the damage (not pre-existing)?

I don't think I have any grounds to go after the flipper here for non-disclosure of a pre-existing issue he knew about because he can just say that this comes with buying a house with old pipes and that tree roots are a natural cause. 

I don't know what a pre-existing relationship between the buyer & seller would have to do with their price to do a title search.Did you figure out how much the statutory fees/taxes are?

They have their own hoops to jump through so if you have a pre-existing commercial banking relationship with a local bank, they may be able to offer the best rates/terms with no seasoning.
