(In any case, it's worth asking your insurance agent what your policy includes and excludes)That being said, I completely agree that it's highly unlikely they would actually sue over something that is pretty open and shut - on what grounds could you see a judge awarding them damages?

I'm in a very Landlord-friendly, common-sense state, yet the court has NEVER, EVER awarded late fees and they never will.You can put anything you want in an agreement and the Tenant may agree to it.
