If it not allowed "by right" based on your current zoning, you could try to pursue a Zoning Variation or Zoning Change in order to get this permitted by the City; however, it's a pretty lengthy and expensive process and is not guaranteed...

The fact that you offered it up doesn't really amount to much if state law already provides that the seller can keep it in the event of default.IANAL, but without a liquidated damages clause, it seems to me that the seller can sue for damages, although if it exceeds small claims limits, it's going to be a lengthy and expensive process for both parties to go to court.
