Gone are the days of throwing up an average property receiving great returns with minimal effort.

So if there is damage that can't be rectified through reasonable effort with both parties (ie. damage that the buyer is not willing to claim on ins., won't credit you the cost to fix, a delay longer than 30 days while the bank is processing "re-inspection', ETC) than you can cancel the contract and receive your escrow back. 

I put a lot of time and effort into finding a new tenant, and there is no gap between the two tenants.Can I still charge the penalty of two months' rent as stated in the lease?

Contract requires diligent effort from buyer but otherwise doesn't specify if they need to try and close the sale or can just throw their hands up at the low appraisal.

This raises risk and increases effort required which is to be reflected in rent increases.  

I put forth same effort as I typically do, but it took much longer to rent.  

Relaxing occupancy limits seems like low hanging fruit in that effort.
