The scenario "Systematic Counterclaim" would just not work in Texas as residential evictions are initiated at the Justice of the Peace level:-Justice of the Peace are elected officials so they have constituents to adhere to and are not bound by precedent -Any appeals require the tenants to pay rent forward until the appeal is heard
