I am trying to help out a friend, who bought a house, that has leasing tenants, in Spalding County, GA.Per the lease agreement, she gave them 60 days notice.However, per the lease, no unauthorized tenant is allowed, and the legal tenant, an elderly lady, only says the man living there is a "friend". she has violated the lease, the man is also a heavy smoker, which also was not allowed by the lease anywhere inside the dwelling.she sent them a notice of violation of lease terms, talked with the legal tenant, and about the mans smoking inside. she requested his drivers license for legal I.D., and was going to work with him on staying until they had to leave, as long as he ceased smoking in the unit.he has refused to respond, and apparently is smoking more, not less, in the unit. the amount of smoke residue, odor, costs to remove the stench, wont be cheap.since he was never on the lease, and the tenant had no legal right to allow someone to come stay, as the NEW Owner, can she file trespass and vandalism charges against the man not on the lease/or arrested for refusing to cooperate ?

Then when I aske them basic things like do you smoke...and they say they didn't see that in the ad it is almost comical since that is literally the first sentence in the add, "No Smokers".Craigslist is definitely much better.

It was a one year lease and after the one year we went to month to month.Back in February my roommate's GF had to move out of her place that she just bought a few months before because her neighbor fell asleep with a lit cigarette and caused major smoke and fire damage, she shared one wall with his unit so she was affected and had to move out to let them go in and fix it.

He doesn’t respect the property as he throw cigarettes out and around the property and is just rough on the property in general.

Our first step is to send the person a "tenant profile" which lays out all our criteria for that particular property such as pet policy, rent amount, income requirements, minimum credit score, smokers not allowed, things that will be screened for, etc.

At this point probably easier to go witht the flow.If you decide to swap them out for non smokers I have a tip for you to get rid of the smoke smell.

Kills bugs better than bug bombs in my experience If it is smell from a super heavy smoker the smell could be in the outlets as well as the A/C vents.
