Our company is planning to open a new service for RE investors in residential clients and perhaps property management companies, according to our employee pool, most of them work at residential short term remodels (3 days to 4 weeks) on the side if we are between jobs (waiting for award or notice to proceed or still bidding).

If the lawsuit is successful, insurance companies will get a settlement for some amount within the policy limits since the lawyers want a payday, and, they know they can't get anything more if the judgment award bankrupts you.It does cost some amount of money to setup and to maintain an LLC.

I've seen two brokers clearly mishandle trust accounts (bouncing returned EM checks) and neither of them were sanctioned or fined.I've spoken to a couple attorneys in my state who have told me that if they were found to have done the same thing, they would have (at very least) been sanctioned by the state BAR the first time it happened.More importantly, the EM holder has some discretion about how to award the money in the case of a dispute.
