I don't think the broker is liable for any damages here, unless there's more to the story.You should also read your contract to see if it has anything to say about the disposition of the EMD in the event of a dispute.

Buy a large amounts of skip traced leads -> Have VA's (I have 3) cold call and vet the leads -> As acquisition, Make a minimum of 80ish calls a day(5 days a week) to touched leads that show some motivation-> Heavy influence of sales (finding motivation, building rapport, finding a price that works, following up) -> Getting a Property in contract -> Disposition(finding a buyer) -> Deal with lien/property/title issues -> Assignment -> Do it over.

.#2 If there are foreclosures, start making contacts with foreclosure attorneys, substitute trustees, asset managers, disposition managers.#3 Attend 5 star conference in Dallas in September 2022....whole industry is there and you start networking and taking classes.#4 If your broker is HUD certified, sign up to take HUD listings.#5 Hang out at the foreclosure auctions so that trustees see you, know you, trust you, and help buyers connect with them.

Along with their disposition of deposit, I included and referenced Bigger Pockets' Vacating and Cleaning Instructions and Itemized List of Common Deductions (both of which were provided to tenants ahead of time), images of the damages, an invoice for the carpet cleaning, receipts for the paint materials, the page of their signed lease saying they are not to paint without permission, and finally the formal $3,200 bid we received.
