We would love to sell but 1. the market isn’t quite were we’d like it to be 2. the association is in litigation and we’ve been told some lenders have an issue with that.

I had a civil case reopened after a motion was filed by the defaulting party on day 29, and the judge said its the defendant's right to do so no matter my inconvenience/cost.At this point, I'd ask your attorney more for a timeline vs. anything else.

So litigating against a LLC would only drain me financially.

My main concern is to protect the assets of my private lender, I need to look further into this due to them possibly having to be on the loan and would like to avoid that due to them possibly being caught in a litigation dispute down the road.

To maintain a civil relationship going forward, I'll aim to chat with him to establish some rules/ boundary for use of the dryer.

@Greg H.A DOT secures a note, OR, a mortgage secures a note, a DOT does not secure both a mortgage and a Note.In CA, the DOT does not outline the foreclosure, the Civil Code does.In CA, a non-judicial foreclosure takes 3 months + 21 days, IF, no bankruptcyIn CA, a re conveyance terminates a loan.In TX, a lien release terminates a loan.In both states a deed of trust is used. 

I wouldn't trust a form you find online and partnerships like that are the biggest cause of nasty litigation in the business.
