I suspect that if you tried this after a month, you would find a judge would rule that you acted in bad faith when signing the original contract and they may void it and/or award damages to your tenant.

You know I really didn't want to go through the hassle, but having not been familiar with awarded lawsuits other than the horror stories I hear about I just wanted to be worry free.

In my state you can't even get awarded late fees or even un paid bills.
