The fear for a long time was that the short hold time by the individuals would cause an "intent to hold" issue with the 1031 exchange. 

I would have the conversation that your intention is to provide as much of the deposit back as possible pending damage.

My intention was to refinance and fully renovate a duplex that was appraised at $740K.

As others have posted here, there is little recourse (other than litigation) for a business "partner" who breaks a contract, or worse, who intentionally defrauds others in the name of "real estate opportunities."   

I would suggest you consult with an RE attorney about what appears to be an intentional non-disclose.
