So while yes any buyer should obtain title insurance especially when confronted with a fact pattern that includes several intra-family transfers, deaths and so forth, unfortunately once a problem like this is discovered, title insurance is not available.The conveyance by D severed the C/D joint tenancy and created a 50% t/c interest for C that has not been accounted for through several transfers over 40 years.

If he confronts her about it, she can tell him she is aware of his pending foreclosure, which proves he is not paying the mortgage, and she will continue escrowing the money until he is caught up on the mortgage and then can pay him everything owed.The foreclosure process takes a while.
