It is state specific, in some it is an ejection order, or writ of possession, in some it is eviction......either way, they have rights as they are occupants, whether they were tenants or previous owners.

I have also seen sellers not understand the process and list their home with an agent to sell, but technically the home has already been foreclosed on but they haven't taken possession yet. 

Get the house in it's final condition then release possession to them.

If you cannot produce that paperwork because the money is actually in your possession or sitting in your accounts or in a safe, that's when you'll wish you had established that account.

So, since no one knows where he is he has not been served, and my options at this point are to cease personal service attempts and have the sherriff post for possession or to keep waiting.
