While it's then a good thing that I wrote that my intention wasn't to be condescending, I'd have been better off writing my post in a way that clearly wasn't.When posting in the forum, you often run the risk of making someone unhappy, even if you're mindful about avoiding it.

I suspect the ROW did not want to get in an argument with you and just kind of went along with your thought process all the while knowing there is no way they are going to agree to your terms in writing.

If it's not in writing then technically its up for grabs, you can fight the broker's split request.

And or if the title underwriter will honor that easement.. who cares what the attorney saysif the title insurance will insure it for the buyer your good to go.but then again maybe closing attornies in your state write the title opinoins :)
