I know you can get around it by listing with a broker, but I don’t know about wholesaling.Typically the tenant waives his/her/its right of first refusal... and the seller records an affidavit that the statute was complied with among the land records.

When you set a rule and the tenants refuse to comply, then you should have a process for notifying them of the violation and penalties to bring them back into compliance or remove them for the violations.1.

Just be careful here as you need to comply with neighborhood CC&Rs as well as city codes.Talk to multiple realtors to see if any of them have any "pocket listings" or know anyone who is considering selling, but hasn't made the decision to list.
