If this is allowed by law, the best way to cover the missapplication of funds issue is to have consent to do so in the lease agreement, but it still does not address the comingling of funds issue.

:(Another point, when doing options or agreements and any public notice is to be filed, that should be done with both parties consent and made with an agreed method to terminate the memo by date or otherwise.
