A few quick comments on your questions and a disclaimer that I'm coming from the perspective of both an investor who does 1031 exchanges and a QI (Asset Preservation) as well:- Capital gain taxes are set to go up from 15% to 20% at this point in time.

I do think you should steer away from this particular property just because unpleasant (from your perspective) things will happen and you won't be able to prevent them.OTOH, it sounds like you may be getting a good deal on it, and that may reflect some of the uncertaininty.
