Also send them a letter that emphasizes the liability of owning a vacant house (specially if it's not insured) and what you can do to help them not have to pay real estate taxes and other expenses with having a vacant home.

Here the landlord law has special provisions for this scenario ... they carry with them a {minimum} 60-day close to allow the tenant enough time to move.I more human way of handling it, is to work with the chosen tenant and Vendor to find a new home for this tenant and help them move {again: at the Vendor's expense if at all possible}.

Contracts are assignable unless they specifically state otherwise, however, if you do not want any problems, make sure to specifically state it in the contract either where you vest it (ABC Buyer, LLC and/or assigns) or include an assignment clause in the special provisions section of the TREC contract.Typically, short sales and REO properties are not assignable due to the clauses the banks have inside their addendums.As to the EMD, you should have your own money to put up for this, but if not, there are ways to do it.
