Even if the incident was an eviction, I would want to know what the circumstances were.... there is a big difference between being legally evicted because an apartment is being converted to a condo and the tenant leaves when asked to do so, in comparison to refusing to leave after ones legal right to stay in a unit has expired and then unlawfully detaining and it becoming a case before the court.

If a lender is not compliant, that might make it harder for them to collect and secure collateral as an unlawful lender, that's not a problem for a borrower.Regardless, there are those willing to lend with a wide range of qualification and underwriting requirements, what any lender requires or is willing to loan on doesn't classify that lender in mortgage lending.

In its response, UDF said that a hedge fund had built “a significant short position” of more than 4 million shares of its publicly traded REIT, and that it believed the fund was “trying to unlawfully profit by manipulating and depressing the price” of the shares—but it did not name the fund.Shorting 4 million shares of one company held by a hedge fund the size of Hayman Capital is a bit different than, "Shorting Real Estate".

Fwiw, you probably have a "right" to show the house with reasonable notice, and you definitely did break the law by entering without notice, but neither issue is a "case" worth pursuing - you can still put him out, and I doubt the police will come calling about an unlawful entry six weeks prior - unless this property is in a hick town.

It is unlawful for a person, in connection with the application for or procurement of a loan secured by real estate to: (1) Employ a device, scheme, or artifice to defraud; (2) Make an untrue statement of a material fact or to omit to state a material fact necessary in order to make the statement made, in the light of the circumstances under which it is made, not misleading; (3) Receive any portion of the purchase, sale, or loan proceeds, or any other consideration paid or generated in connection with a real estate closing that such person knew involved a violation of this section; or (4) Influence, through extortion or bribery, the development, reporting, result, or review of a real estate appraisal, except that this subsection does not prohibit a mortgage lender, mortgage broker, mortgage banker, real estate licensee, or other person from asking the appraiser to do one or more of the following: (a) Consider additional property information; (b) Provide further detail, substantiation, or explanation for the appraiser's value conclusion; or (c) Correct errors in the appraisal report in compliance with the Uniform Standards of Professional Appraisal Practice.2.

This will only get YOU into trouble.Find and follow the Unlawful Detainer case rules OR immediately find and engage a local eviction company.There's nothing to be gained by procrastinating or attempting to "heal the relationship" - - it only gets worse :sigh:
