You can have damages for them failing to perform.While you can have filing options to cloud title, any can be removed ultimately and if they decide not to sell, such a filing is useless as they are still in possession.You can get nasty, fight, threaten suit (and if you do you better follow through) to motivate a seller, but you can't force their hand to sign any deed.Usually, if they really can't be motivated to sell, take the damages and walk away, it could be more than you'd make on a deal, especially after legal battles. :)

Especially in light of the fact that I havent been so much as a day late on my HOA dues in at least 2 years.They are threatening to put a lien on place and pursuing me legally if need be.

The plus to not chasing it is that if you want a tenant out, you can then use that unpaid rent as reason to threaten eviction to the tenant and they will pack up and move.

The buyer even extorted my brother by threatening criminal prosecution for things that didn't even apply to my brother.The buyer scared my brother into signing a release document that ended the purchase contract.

Now, that was better advice by all above.Never threaten a law suit unless you intend to carry it through as that is grounds for a suit against you!

We are finishing up a rehab project right now and the contractor that was doing the work was doing a horrible job, taking too long and causing a lot of issues, so I decided to fire him this past Friday and cut my losses.I haven't paid him his final draw yet and based on the quality of work (or lack there of) and he was already at his time deadline based on our contract and had at least a third of the scope of work still unfinished or needing redone because of how bad the finish work was.I tried to negotiate a final amount for us to agree upon to part ways and have the contractor sign the final lien waiver, but he is requesting more than what I think he deserves and he is threatening to file a mechanics lien against our property if I don't give him what he wants.Any thoughts or suggestions on what my rights are and how I should handle this???
