Escrow a release for the lien and for the memorandum with a neutral 3rd party who will record the releases upon conclusion of the option contract.Also consider getting from a title company a "title insurance policy with option endorsement" to protect your right to exercise the option.A $40K option price that is paid $500 per month as additional option consideration is 0% seller financing.

The reason I'm posting is to say that the lender can call that shot as well since FHA is guarantees the loan but it can be repurchased in default as well, usually not but may/can be with direct endorsment lenders.

:)george, my city sent out letters that those "pipe protection" letter that people are getting are not just fake (not endorsed by the city), but they are fake and offer no protection at all. so, i think you are wasting your money.

Additionally we always make sure we have a good exit strategy (lined up wholesale buyers or a reliable back up lender).I find that my lenders stay loyal because not only do I offer them great interest rates, I also provide them with a copy of the mortgage, the original promissory note (drafted by our attorney) and insurance endorsement naming them as the mortgagee.
