I want to be legal but it feels a little ambitious where this falls.

Hi Jessica, if they ban smoking, I believe it will be legal and life for the smoking tenant will quickly become unbearable.

@Jose Saladin you will likely not get a CO (certificate of occupancy) to be able to legally rent this out.

If you represent the leasable space as what's in the condo plan and they accept then that's the space they're paying for, I'm not aware of a legal obligation one way or another.
