That just seems absurd.I did find the following in the Colorado Common Interest Ownership Act:"(1) Except as provided by the declaration:(a) If walls, floors, or ceilings are designated as boundaries of a unit, all lath, furring, wallboard, plasterboard, plaster, paneling, tiles, wallpaper, paint, and finished flooring and any other materials constituting any part of the finished surfaces thereof are a part of the unit, and all other portions of the walls, floors, or ceilings are a part of the common elements."

Some places don't allow for collecting different types of deposits (they allow just the one called security), so check whether that is permitted by law in your area.The security deposit is intended to cover any and all damages due to occupancy by the tenant, including their pets; you'll first have to use up that non-refundable pet deposit amount before tapping the regular security.Normally, after a pet move out, you might have to fumigate for fleas and ticks, and have a heavy cleaning of carpet to get fur out.

Seems rather like a can of worms to me (He technically has is own dorm room at the university.).If it were mine (and he's just visiting day or night) I'd not notice it (this is 2022 and not 1950 like Mr Furly in 3's Company).If you think the Young Man has taken up legal residence with the Young Lady under your lease, and the language in the lease disallows this--I would think about calling her and just asking (in a nice way)...if she says yes...take it from there, if she says no I'd drop it--and collect the rent.You have no proof he lives there...just somewhat of a guess...and they may just enjoy each others company so much they get married...then you can see about adding him to the lease.Good Luck!

I'd suggest instead you take that $18,951 and buy your wife a really nice fur coat (we're talking Fairbanks here, it can get kind of chilly @ -40) and buy her a trip to Hawaii instead.
